Voyage - Terms & Conditions

Definitions

"Customer or You" means the individual accessing or using this service and booking a Voyage, or the company, or other legal entity on behalf of which such individual is accessing or using the service, as applicable (including minors with consent from their legal guardians).
"Hype Club/We or Us" means HYPE PERFORMANCE AND RECOVERY CLUB - L.L.C - S.P.C ("HYPE Club") the company providing the Voyage service and the company that maintains the website https://voyage.hypeclub.com
"Voyage" means the wellness cruise boat trip service or dockside boat service operated by Hype Club and which you are consenting to attend on the basis of these Terms and Conditions.

• Tickets are non-refundable once purchased.
• Customers booking a Voyage through this website must be a minimum of 18 years of age.
• Customers must arrive on time and there are no refunds for missed departures. You should arrive 15 minutes before the booked time.
• Customers may reschedule their ticket once, to a future Voyage if requested in writing at least 2 weeks in advance of their scheduled ticket.
• Tickets are transferable to another individual, only if Hype Club is notified at least 48 hours in advance.
• We accept Visa or MasterCard debit and credit cards in AED or cleared bank transfers will also be accepted for payment.
• It is your responsibility to ensure that the details you provide during your booking are correct and you will receive confirmation of the services booked. You must retain a copy of the transaction records and are responsible for maintaining the confidentiality of your account.
• Customers purchasing a ticket on behalf of someone else, are responsible for informing them of these Terms & Conditions before the event.

• In the unlikely event that Hype Club needs to reschedule a Voyage primarily due to weather or other required adjustments, Customers will be informed promptly and may choose a full refund or reschedule for another Voyage date which is mutually acceptable.
• The itinerary, class schedule, and amenities are subject to change to maintain safety, quality, or Customer well-being. Adjustments may be made due to weather, sea conditions, or operational needs.

• Customers participate at their own risk.
• Customers must follow all crew instructions and safety guidelines and undertake in any case to submit to the orders of the captain and the other Voyage crew.
• Hype Club reserves the right to refuse entry or remove Customers from a Voyage at their absolute discretion particularly if the Customer is affecting others or disrupting the Voyage experience.
• Substances that impair judgment are not permitted during wellness activities.
• Hype Club is not liable for injuries or loss of personal belongings.

• Customers must be physically able to participate in wellness activities, including yoga, pilates, and hot and cold contrast therapy.
• Those with medical conditions or injuries should consult a doctor before attending a Voyage.
• Any inability to swim must be identified to the Voyage crew in advance.
• You must inform the Voyage crew of any food and beverage allergies in advance of the Voyage.

• Customers consent to be included in photography and filming during the Voyage and consent to use of their images for Hype Club marketing purposes on all forms of media dissemination (including but not limited to social media channels).
• If you do not want to be included in any media, you must opt out in writing in advance of the Voyage.
• HYPE Club is the owner of all intellectual property rights relating to any images used by it. You may not, under any circumstances, reproduce, modify, transmit, publish, adapt, on any medium whatsoever, by any means whatsoever, or exploit in any way, all or part of the HYPE Club website or any of its social media content without the prior written permission of HYPE Club.

• The parties acknowledge that this agreement shall be governed by laws of the Emirate of Abu Dhabi and the Federal Laws of the UAE as interpreted in the Emirate of Abu Dhabi.
• Any purchase, dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of UAE as interpreted in the Emirate of Abu Dhabi.

• have read and agreed to these Terms & Conditions and acknowledge that you are purchasing an online booking on the Hype Club website which constitutes acceptance of these Terms and Conditions.
• understand that participation is at your own risk, and Hype Club is not liable for any injuries, resulting health conditions and/or medical emergencies which you may sustain during the Voyage.
• accept full responsibility for informing any individuals that you have purchased tickets for of these Terms and Conditions.
• understand that participation in a Voyage is voluntary and at your own risk.
